TERMS OF SERVICE

These Terms of Service govern your use of chaikastudios.ca and purchases from Chaika Studios, a sole proprietorship based in British Columbia, Canada. By accessing the website or placing an order, you agree to these terms and to our Privacy, Shipping, and Return and Refund policies.

Products and orders

Our framed photography prints are made to order. Product colours, cropping, and appearance may vary slightly between screens and the finished print. We may correct errors, update information, limit quantities, or cancel and refund an order that cannot be fulfilled.

Pricing and payment

Prices are displayed in the currency shown at checkout. Applicable taxes, shipping upgrades, duties, and import charges are added where required. Payment must be authorized before production begins.

Changes, cancellations, and returns

Eligible items may be returned within 14 days after delivery in unused, undamaged condition and original packaging. Customers are responsible for tracked and insured return shipping for change-of-mind returns. There is no restocking fee. Order changes or cancellations must be requested within 15 minutes of purchase and cannot be guaranteed once production begins. Damaged, defective, or incorrect items must be reported within 7 days of delivery with the order number and clear photographs. See our Return and Refund Policy for full instructions. These terms do not limit rights that cannot be excluded under applicable consumer law.

Shipping

Delivery estimates are not guarantees. Chaika Studios is not responsible for carrier delays or for delays caused by incorrect addresses, customs, weather, or events outside our reasonable control. Risk of loss passes as permitted by applicable law.

Acceptable use and intellectual property

You may not misuse the website, interfere with its operation, attempt unauthorized access, or use its content unlawfully. All photographs, artwork, branding, text, and site content are owned by or licensed to Chaika Studios and may not be copied, reproduced, sold, or commercially used without written permission.

Third-party services

The store is powered by Shopify and may use payment processors, carriers, analytics providers, and production partners. Their services may be subject to separate terms and policies.

Disclaimers and liability

To the maximum extent permitted by law, the website and services are provided without warranties beyond those expressly stated or required by law. Chaika Studios will not be liable for indirect, incidental, special, or consequential losses. Any liability relating to a product or order will not exceed the amount paid for that product or order, except where applicable law requires otherwise.

Governing law

These terms are governed by the laws of British Columbia and the applicable federal laws of Canada. If any provision is unenforceable, the remaining provisions continue in effect.
